UK Domain Registration
FireStorm-Hosting.com will accept new domain registrations onto our system and register them as soon as is possible, and after payment has been successfully processed.

However until the domain is showing as registered to the customer via our WHOIS search we can not guarantee the domain has been secured for a customer. The domain registration period runs for the amount of time you select when your order the domain, and starts from the date of successful registration.

Domain names can be registered for periods of 1 - 10 years depending on the domain extension. Some domains have a minimum term of 2 years.

Domain Registrant
Unless you specifically request that we register the domain on your behalf, we will register all domain names in the account holders name or an additional name specified by the account holder, we do this so that businesses can register domains on behalf of their clients.

The registered domain owner with Nominet is the details you supply us. FireStorm do no register domains 'on your behalf' by default, which means you are legally the domains owner.

Domain Transfers
Firestorm Hosting do not charge fees for transferring domain names either in or out of our system when the domain name is used in conjunction with one of our hosting packages (including trial packages).

Domain names that are not used with one of our hosting packages may be subject to a transfer administration charge of £15.00 per domain if they are transferred into our system free of charge and then transferred away within 2 years

Domain Expiry
The domain registration can be renewed automatically or set to expire login to your account to adjust your renewal preferences.

Renewals are subject to domain registration fees.

Once a registration has been completed no refunds can be made by FireStorm-Hosting.com. Until the customer receives confirmation of successful registration from FireStorm-Hosting.com there is no guarantee that the domain name requested will be registered.

Your Agreement
The customer agrees that all details submitted in respect of a domain name registration are true and correct.

The customer declares to FireStorm-Hosting.com that the registration of a domain name and the way in which it is used (directly or indirectly) does not infringe the legal rights of any third party.

FireStorm-Hosting.com does not accept any responsibility for the use of registered domain names especially where there may be conflict over rights to ownership or copyright.

The customer indemnifies FireStorm-Hosting.com from any legal proceedings and costs that arise as a result of the registration of a domain name.

When you register a .uk domain name with FireStorm, you also enter into a contract of registration with the internet domain authority 'Nominet UK'. You can read their terms and conditions here. This is a separate contract to any arrangement you have with FireStorm-Hosting.com.

US Domain Registration
FireStorm-Hosting.com will accept new domain registrations onto our system and register them as soon as is possible, and after payment has been successfully processed. However until the domain is showing as registered to the customer via a WHOIS search we can not guarantee the domain has been secured for a customer.

Please note: by registering a TLD (Top Level Domain) you must also agree to the terms as set out in the 'Tucows agreement'

We are also governed by the Uniform Domain Name Dispute Resolution Policy

Web Hosting Terms Of Service
Server use: Firestorm-Hosting.com reserves the right to refuse service and/or access to its servers and/or services to anyone.

Firestorm-Hosting.com does not allow any of the following content to be stored on its servers:

• Mirror Sites Used to bear high bandwidth downloads.
• Excessive download content or non-linked content.
• Refusal of service based on content matching either of these two criteria is entirely at the discretion of Firestorm-Hosting.com.
• Firestorm-Hosting.com reserves the right to move your website, database or data to a different server with no previous notice.

Support
We will do our best to provide you with the continuous high quality service you expect from FireStorm. If you experience any problems with any of your services, you should visit the support section of our website.

Please Note: Should you fail to find a resolution to your problem in our support centre, then please call a member of our team who will do everything possible to help resolve any issues.

Please be aware that servers do require maintenance or updates occasionally, all maintenance is scheduled and is normally completed very quickly. Information about scheduled maintenance can be found in the support section of the website along with any known system issues.

Reselling of Services
All accounts are to be used by the primary account owner only, we do not allow the holders to resell, store or give away web-hosting services of their website to other parties.Web Designers etc.. are permitted to register and administer multiple domains and web sites all from their primary account, but services must not be split between multiple site owners.Example: You must not allow more than 1 company access to the same database, by reselling tables.

Unlimited Use Policy
High bandwidth usage: Firestorm-Hosting.com offers an unlimited use policy by maintaining very large ratios of bandwidth per customer. In rare cases, Firestorm-Hosting.com may find a customer to be using server resources to such an extent that he or she may jeopardize service performance and resources for other customers. In such instances, Firestorm-Hosting.com reserves the right to impose the High Resource User Policy for the consideration of all customers.

Database Usage and Charges
If you exceed the limits on our database products (MS SQL and My SQL) then we will automatically upgrade your database to next available size. For example if you have a 150MB database and your data size increases to 200MB at any point then we will upgrade your database to a 300MB database See the pricing section for info on database costs.

High Resource User Policy
Resources are defined as bandwidth, processor utilization or disk space. Firestorm-Hosting.com may implement the following policy at its sole discretion: When the resources utilised by a customer using a service appear abnormally high, Firestorm-Hosting.com reserves the right to suspend that service immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our services. Customers may be offered an option whereby Firestorm-Hosting.com continues supplying the service under a reduced usage criteria specified by Firestorm-Hosting.com. Failure to comply with such measures may result in your service being terminated

Uploads via script
For security reasons our servers have a limit on uploads made via scripting languages - including PHP, ASP and ASP.NET. Uploads made using PHP are limited to 20MB per file.

Payment And Pricing Policies
All accounts are set up on an annual payment basis. Although Firestorm-Hosting.com reserves the right to change prices of accounts or services at any time, all pricing is guaranteed for the period that has been paid for. Any changes to prices will be clearly communicated to all customers prior to their application, with customers being given one month's notice of any changes. Notice will be served via email, to the email address held on the Firestorm-Hosting.com account. Payment is due every 365 days, from the date the account was established. Customers will automatically be charged again at the end of their prepay period unless confirmation of the wish to close has already been received. In situations where the payment is declined by the bank, Firestorm-Hosting.com will immediately suspend the facility to purchase services on-line until the outstanding charge is processed successfully. In addition, Firestorm-Hosting.com reserves the right to suspend other services until the outstanding debt is cleared. Any non-payment of a recurring invoice may be subject to a £10 administration charge. The customer is responsible for all money owed on the account from the time it is established until the customer sends a written cancellation request.

No bills or invoices will be sent by regular mail unless specifically requested. All invoices will be sent directly to customers via email shortly after the online purchase has been made. At this point the customer's card will be charged automatically.Please refer to our Domain Name terms of service for Domain Name specific payment policies.

Your Personal Details
Please note that whilst your email is primarily used for billing purposes, Firestorm-Hosting.com reserves the right to email you information about enhancements to our systems and product offerings. You can unsubscribe from marketing communications within your Firestorm control panel. We will not provide any of your personal information to other companies or individuals without your permission. However, we may need to provide your name and delivery address to third parties that Firestorm-Hosting.com may use for the purposes of delivering specific services to you (e.g. customer support).

Contract Terms
All web hosting, email, broadband, dedicated server and all related features are subject to a 12 month minimum contract term.

Cancellations
After the minimum contract period, customers may cancel any package by contacting the Customer Care team on +44 0845 30 88 329 (Monday to Friday, 10:00am to 8:00pm UK time).

Customers must provide details of the account/package to close, including the account password for verification. Firestorm-Hosting.com will not, under any circumstances, close an account without first confirming the accounts owner password. Customers may be required to complete an account closure confirmation form, authorising the permanent removal of all website and email services on the account, from our system. On receipt of a completed closure confirmation form, the account will be scheduled to close. Firestorm-Hosting.com will acknowledge the closure by sending an email to the email address registered on the account. If Firestorm-Hosting.com does not receive the completed closure confirmation form within 14 days of sending, the cancellation request will be discarded and the account/package will remain open.

Any incentives that were offered to customers when opening their account will also be cancelled. Customers may be given the option to purchase services which were offered as start-up incentives, in the result of a cancellation. Firestorm-Hosting.com reserves the right to cancel the service at any time.

Refunds
Fees charged on a pre-pay basis (together with account set-up fees, where applicable), are non-refundable. Customers will only be entitled to a refund when the service is within a trial period, or where the service is cancelled by Firestorm-Hosting.com. In the event that Firestorm-Hosting.com cancels the customer's service, the customer will be entitled to a pro rata refund based upon the remaining period of membership.

If a customer contravenes Firestorm-Hosting.com' Terms of Service a refund may not be issued in the event of a cancellation. Customers who cancel during the initial 30 day trial period will only be entitled to a full refund for their hosting fees, but will not be entitled to a refund for any additional services purchased.

Any incentives offered to customers when opening the account will also be cancelled. Customers may be given the option to purchase services which were offered as start-up incentives in the result of a cancellation.

Domain Name purchases are non-refundable.

Charge-backs
Any customer withdrawing payments via bank or credit card (a "chargeback") may be subject to a punitive fee of £50, should the company deem this chargeback to be unfair. The company also reserves its right to defend such charge-backs and recover the original payment from the card holder.

Disclaimers and Warranties
Firestorm-Hosting.com does not back up Your data/website unless you have specifically purchased one of our backup plans along with your hosting package, and whilst every attempt would be made in the unlikely event of any corruption or hardware failure,

Firestorm-Hosting.com cannot guarantee to be able to replace lost data. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Firestorm-Hosting.com and its employees.

Firestorm-Hosting.com makes no warranties or representations that any service will be uninterrupted or error-free. You accept all services provided hereunder "as is" without warranty of any kind. All implied conditions, warranties and terms (whether express or implied by statute, common law, custom or otherwise) including, but not limited to, those relating to the exercise of reasonable care and skill, fitness for purpose and satisfactory quality (where applicable) are hereby excluded in relation to each of the services to be provided hereunder to the fullest extent permitted by law.

Firestorm-Hosting.com shall not be liable for any services or products to be supplied by any third party.

Firestorm-Hosting.com shall not be liable directly or indirectly for any loss or damage whatsoever, suffered by You and arising out of or in connection with any breach of this Agreement by You or any act, misrepresentation, error or omission made by You or on Your behalf.

Firestorm-Hosting.com will not be liable for any indirect loss, consequential loss, loss of profit, revenue, data or goodwill howsoever arising suffered by you or for any wasted management time or failure to make anticipated savings or liability you incur to any third party arising in any way in connection with this agreement or otherwise whether or not such loss has been discussed by the parties pre-contract or for any account for profit, costs or expenses arising from such damage or loss. No matter how many claims are made and whatever the basis of such claims, Firestorm-Hosting.com maximum aggregate liability to you under or in connection with this agreement in respect of any direct loss (or any other loss to the extent that such loss is not excluded by other provisions in this agreement) whether such claim arise in contract or not, shall not exceed a sum equal to twice the fees paid by you for the services in relation to which your claim arises during the 12 month period prior to such claim. None of the clauses herein shall apply so as to restrict liability for death or personal injury resulting from the negligence of Firestorm-Hosting.com, its employees or its sub-contractors. Firestorm-Hosting.com shall not be liable for any interruptions to the services or outages arising directly or indirectly from:- General interruptions to the flow of data to or from the internet; changes, updates or repairs to the network or software which it uses as a platform to provide the services; The effects of the failure or interruption of services provided by third parties; factors outside the reasonable control of Firestorm-Hosting.com; your actions or omissions (including, without limitation, breach of your obligations set out in the agreement) or those of any third parties; problems with your equipment and/or third party equipment; interruptions to any of the services requested or used by you.
